What happened: Medicare and Medicaid officials released guidance today letting states sort diagnoses into tiers when deciding who is exempt from the new 20-hour-a-week work requirement. A top-tier diagnosis — end-stage kidney disease, ALS, end-stage cancer — exempts a patient automatically, no paperwork. A middle tier needs supporting data such as recent hospital billing or pharmacy records. Everything else gets reviewed case by case.
Why it matters to you: Most expansion states switch this on January 1, and the middle tier is explicitly built on "repeated inpatient admissions for serious or complex conditions" — which means the admission you write tonight on a frail 58-year-old with three chronic illnesses may be the record that keeps their coverage next year. Budget analysts expect over 7 million people to lose Medicaid as this rolls out.
Do this: When you admit a working-age Medicaid patient, put the qualifying condition in the problem list by name rather than leaving it implied in the narrative — the exemption is read off diagnosis codes, not your prose.
Otherwise quiet in the window: no new hospital-medicine guideline, no task-force statement, no Medicare hospital rule, no new shortage notice since last night. Three candidates were checked and dropped — see the background drawer below.
Why it's live: Every note you close turns into a CPT code, and that code set is the private copyrighted property of the American Medical Association, which licenses it for $82.50 a year plus $18.50 per user. Two things are squeezing that arrangement at once. PatientRightsAdvocate.org sued the AMA on August 13 in federal court in Chicago to strip the copyright. And Medicare's proposed 2027 physician fee schedule contains a formal request for comment on "harms or challenges associated with AMA's monopoly over CPT-4 licenses," on alternatives to the CPT and RUC processes, and on whether physician procedures could be paid off ICD-10 procedure codes instead. Comments close Monday, September 14.
Cynthia Fisher, who founded PatientRightsAdvocate.org, argues the codes stopped being private property the moment the government wrote them into law: "Americans should not have to pay a private trade association for permission to see how their medical care is billed and priced." Her filing runs three ways at once — that a standard incorporated into federal and state law can't be copyrighted, that republishing it is fair use, and that the AMA has misused the copyright. The government's own comment request goes further and asks whether the whole valuation apparatus should move somewhere less conflicted, since the same association that owns the code set also convenes the committee that recommends what each code is worth.
The AMA's position is that the code set is not a rent, it's a product that requires continuous maintenance by people who understand clinical care. Its spokesman: CPT "serves as the uniform language of medicine, updated continuously through an open, transparent process that reflects evolving clinical care," and the association "will vigorously defend" its rights. AMA President Willie Underwood III framed this week's release of the 2027 code set — 299 new codes, ten of them for artificial-intelligence services — as the evidence: "Medicine advances at an extraordinary pace, and the CPT code set must advance with it." The implicit warning is that a free code set with no funded steward is a stale code set, and that swapping in ICD-10 procedure codes would describe hospital procedures reasonably well and office medicine badly.
Where it lands: Three separate forks. The legal one — whether a privately authored standard loses copyright protection once law requires its use — has been fought before over building codes and has gone both ways. The regulatory one is whether Medicare actually does anything after Monday, or whether the comment request was a shot across the bow. And the practical one is the question nobody has answered: if not CPT, then what, maintained by whom, paid for how. Worth ten minutes of your week off if you want to file a comment before Monday.
